A revolution in development conditions. What do the regulatory changes taking effect after September 1, 2026, mean for investors and property owners?

Planning a construction project or purchasing land for a dream home today requires investors to possess not only a keen sense of the market but, above all, a high degree of legal caution. September 1, 2026, will certainly go down in the history of the Polish real estate market as a watershed moment. Key reforms to planning law came into effect then, fundamentally changing the rules for issuing decisions on development conditions (commonly known as “WZ” decisions).

As the legal team at Partners International, we advise Clients daily on safely navigating complex transaction and investment procedures. In this article, I explain in accessible terms exactly what changed after September 1, how the new regulations affect plot values, and what requires special attention before deciding to purchase a property.

2026 PLANNING LAW REFORM: ABSENCE OF A GENERAL PLAN AND THE BLOCKING OF NEW APPLICATIONS

The most significant change concerns the direct link between the ability to obtain a development conditions decision (“WZ”) and the municipality’s possession of a so-called “general plan.” This is a new planning document intended to eventually replace the existing studies of conditions and directions of spatial development.

What does the situation look like in practice?

  • In municipalities that have adopted a general plan: decisions on development conditions are still being issued; however, any new development conditions decision must be 100% consistent with the provisions of the general plan.
  • In municipalities without a general plan: it is worth noting that this issue currently affects approximately 65% of local authorities in Poland. The regulations here are unequivocal. In municipalities that fail to adopt a general plan in time, officials cannot issue decisions on development conditions (WZ decisions) for new applications submitted after August 31, 2026. Proceedings in such cases are automatically suspended until the document is enacted.

According to the Ministry of Development and Technology, most municipalities are expected to work intensively to clear this backlog, with a wave of new plan adoptions anticipated by the end of the current year. However, until this happens, the process of issuing new decisions in these areas remains frozen.

WHAT ABOUT APPLICATIONS FOR DEVELOPMENT CONDITIONS SUBMITTED BEFORE SEPTEMBER 1, 2026?

Many of our Clients ask about the status of those who submitted documents just before the described changes took effect. Transitional provisions guarantee the protection of acquired rights: if an application for development conditions was effectively delivered to the relevant authority no later than August 31, 2026, the case is processed under the existing rules, even if the municipality has not yet adopted a general plan.

However, it is worth noting the other side of the coin. Due to the upcoming reform, municipal offices across Poland experienced a massive influx of applications in late August. Consequently, the actual waiting time for a decision on cases filed in the summer of 2026 has now extended to many months.

NO MORE INDEFINITE VALIDITY: THE 5-YEAR RULE

For years, a key advantage of decisions on development conditions (known as *WZ* decisions) was that they were assigned to a specific property indefinitely. The amendment permanently abolishes this rule for new proceedings.

Any new decision on development conditions, where the procedure was initiated after October 16, 2025, will have a strictly defined validity period of five years from the date it becomes final. This means the investor has exactly five years to obtain a final building permit. If the necessary legal steps are not taken within this timeframe, the decision on development conditions will expire, and the entire procedure will have to be started from scratch.

Who is exempt from the 5-year limit? Decisions that became final before the start of 2026 retain their indefinite validity, as do all those for which an application was submitted prior to October 16, 2025.

A REVOLUTION IN SITING: INFILL DEVELOPMENT AREAS (OUZ)

Another pillar of the new reform is curbing uncontrolled urban sprawl in areas lacking adequate infrastructure. Under the new legal regime, a decision on development conditions can be obtained only for land located within designated “Infill Development Areas” (known in Polish as “OUZ”). Municipalities designate these zones directly within their general plans.

What does this mean for property owners?

  • Plot within a built-up area: If the property serves, for example, as an infill site between existing residential buildings or is immediately surrounded by developed infrastructure, it has a strong chance of falling within the designated urban infill zone (OUZ).
  • Plot in an isolated area: Plots located far from existing development and technical infrastructure have effectively lost the possibility of obtaining a new decision on development conditions (WZ decision).

Additionally, it is worth noting the scope of the so-called urban planning analysis (examining the “good neighbor” principle). Prior to the reform, officials would examine an area extending hundreds of meters or more around the plot. Currently, this area has been drastically reduced, and the analysis may cover a maximum distance of 200 meters from the property boundaries.

SUMMARY OF THE SITUATION REGARDING THE PLANNING REFORM: OLD VS. NEW RULES

To clarify and organize this information, a comparison of the key differences in the issuance of WZ decisions is presented below:

Feature / Parameter Old rules (applications until 31 August 2026) New rules (applications from 1 September 2026)
Validity of the decision on development conditions Indefinite (for applications initiated before 16 October 2025) Always 5 years from the date it becomes final and binding.
General Plan requirement No requirement (cases processed under the old regulations) Yes. No general plan = no possibility of issuing a decision on development conditions
Location of the investment Any type, provided the “good neighbor” principle was met. Exclusively in Infill Development Areas zones designated in the general plan.
Scope of the urban planning analysis Flexible, often several hundred meters or more Up to 200 meters around the plot boundaries

What should you keep in mind before buying a plot of land? Arecommendation from an expert

If you are planning to purchase a building plot or undertake a new development project on land that lacks an adopted Local Spatial Development Plan (MPZP), the first and absolutely crucial step is a thorough legal audit of the property.

Before signing a preliminary agreement or paying a deposit, you should verify:

  • Whether the municipality has already adopted a General Plan (this information is published in the Public Information Bulletin (BIP) or can be obtained directly from the municipality’s architecture and urban planning department).
  • Whether the plot you are interested in is located within an area designated as an Infill Development Area (OUZ).

Groundbreaking changes in planning law mean that assessing a property’s potential now requires a much deeper analysis than in the past. To avoid the risk of purchasing land where your intended construction project proves impossible to realize, it is advisable to entrust the verification of the legal status to experienced experts.
